Diplomatic Immunity
In order to provide protection for foreign diplomats, “diplomatic immunity” laws are recognized internationally. Under these laws, personnel who may be subjected to abuse or animosity because of foreign relations are protected and immune to trial. Unfortunately, this means that crimes committed by foreign diplomats are not tried in the country which they occurred. This has become increasingly problematic in cases where the crime was completely unrelated to their diplomatic duties.
If you have been involved in an accident with a foreign diplomat, you will need an experienced legal representative to get the justice you deserve. Call 1-800-739-2235 to schedule a free consultation with a professional who will help you determine your legal options.
Intent versus Reality
The original intent for these laws was to protect personnel travelling with diplomatic status during times of war; however, since the establishment o these laws, they have been abused. While it is stated that diplomats are expected to abide by local laws, they do not always do so. Crimes committed by diplomats include:
- Espionage
- Smuggling
- Child custody law violations
- Traffic violations
- Murder
When suspected of committing a crime, the hosting country cannot try them in court. Instead, they must notify the diplomat’s home country and inform them that they are no longer welcome. Only in rare cases will a home country waiver diplomatic immunity and allow their people to be tried in another country’s courts.
