WHAT IS INSURANCE BAD FAITH?
The Oklahoma Supreme Court and other courts around the country have found that insurance companies have a
special relationship with their customers which involves the duty of "good faith and fair dealing". They
are obligated to properly and promptly investigate and pay your claims and to have reasonable and
legitimate reasons for denying claims.
The insurer's duty is based on the fact that ordinary people seldom have any real bargaining power when
purchasing a contract of insurance, that any questionable phrases in an insurance contract should be
interpreted in favor of the insured, and that an insurance company should not take advantage of an insured
when the insured is most vulnerable and in need of help.
If an insurance company acts in bad faith, the insured may recover money damages to compensate him or her
for the benefits which were not paid, for other monetary losses which occurred as a result, for emotional
distress, and for attorney fees. If the judge and then the jury find that the insurance company acted
willfully or maliciously, punitive damages may be awarded. Punitive damages are not to compensate the
plaintiff, but to punish the defendant for wrongful conduct.
