Three Killed in Oklahoma Auto Accident

Three people were killed in an Oklahoma car accident Monday.

According to officials with the Oklahoma Highway Patrol, the accident occurred six miles west of Madill on U.S. Highway 70 shortly before 1:00 a.m. Monday. Police say 43 year-old Sherry Ann Bullard and 61 year-old Elizabeth Ann Seymour were pronounced dead at the scene of the accident.

According to the accident report, Chickasaw Lighthorse police were chasing a stolen 2007 Cadillac Escalade on the highway when the driver, 22 year-old Pedro A. Garciga, turned off the vehicle’s headlights and collided head-on with the vehicle driven by Bullard. Airbags were deployed in both vehicles. Seatbelts were in use by the driver and one passenger in the Suburban. It is unknown if Garciga was wearing his seatbelt at the time of the accident.

Garciga was transported by AirEvac Helicopter to Oklahoma University Medical Center for treatment. He died during surgery at 6:41 a.m.

Premises Liability Lawsuit Filed Over Slip and Fall Accident

A Texas woman has filed a premises liability lawsuit against a Fort Bend grocery store, claiming she sustained serious injuries while shopping.

According to Harris County District Court documents, Edilberta Gonzalez accuses Cox’s Foodarama of Houston of negligence. Gonzalez says that on July 17, 2009 she sustained serious injuries while shopping at Foodrama Store No. 21. The lawsuit claims Gonzalez slipped and fell on a liquid substance “carelessly” left on the floor.

Gonzalez is asking the court for an unspecified amount of damages, in addition to court costs.

Officials at Foodarama declined to comment on the lawsuit, saying the company had not yet reviewed the complaint.

$35M Verdict in Slip and Fall Lawsuit

A woman who suffered was injured in a slip and fall accident onboard a Carnival cruise ship in 2009 has been awarded $35 million in damages.

Denise Kaba filed a slip and fall lawsuit against Carnival Cruises last year in the District Court for the Southern District of Florida. According to the lawsuit, Kaba was injured when she slipped on the pool deck of the Carnival Pride cruise ship on August 22, 2009. The lawsuit claims the use of a resin surface on the pool deck caused Kaba to fall.

Kaba alleged that Carnival was aware of numerous prior slip and fall injuries on Carnival Pride pool deck.
Kaba sustained a fractured knee cap in the accident and required six surgeries.

She was awarded $2,998,155.70 in damages for past medical expenses, future medical expenses, and loss of earning capacity.

Slip and Fall Lawsuit Filed Against Pasadena Walmart

A woman filed a premises liability lawsuit against a Pasadena Walmart, claiming she was injured in a slip and fall accident at the store.

According to Harris County District Court documents, Pasadena-resident Nora Hernandez filed the premises liability lawsuit on March 30 against Wal-Mart Stores. The lawsuit alleges negligence.

According to the complaint, Hernandez was seriously injured on April 17, 2009 while she was shopping at Walmart store no. 2724, located at 1107 Shaver St. in Pasadena. Hernandez, who was pregnant at the time of the accident, claims she slipped and fell on a pool of water that had gathered on the floor. The lawsuit says the fall caused Hernandez to injure her back, knee, and abdomen.

The lawsuit contends the store’s employees knew of the water and did not act in a timely fashion to clean it. Hernandez is asking the court for an undisclosed amount for actual damages and court costs.
